Contractual Advice

The purpose of a construction contract is to set out obligations, specify responsibilities and allocate risk, including defining the commercial arrangement.

Poor contractual advice and inappropriate contract choices can result in Clients:

  • Being exposed to risks that they hadn’t expected
  • Being unable to achieve their objectives
  • Facing higher than necessary costs and potential claims

The correct choice of contract provides a solid foundation for success, whilst knowledgeable, well targeted contractual advice prevents or resolves problems, avoiding wasted time and cost (which can be substantial).

The Stradia team excels in providing contractual advice that minimises risk and solves problems, based on extensive knowledge and experience of the commonly used suites of contracts, including:

Our team comprises construction contract specialists and qualified lawyers (including renowned expert Roger Knowles) who can advise on all contractual matters from day-to-day issues through to strategy and particularly difficult or sensitive points of law - enabling our clients to implement the best contractual solutions for their situation.

We work closely with our clients to maximise their potential for delivering value for money and to prevent complex construction problems or disputes from arising. If problems have arisen we assist in resolving them quickly and cost effectively.

How we can help

  • Training – our practical consultancy work provides the experience upon which we base our in-house seminars and training (which include all the standard forms of construction contract, contract law, commercial awareness, claims preparation analysis, negotiation skills and adjudication)
  • Choice of contract – can be a complex and important decision – we ensure that the optimum form of contract is selected and that the terms are both relevant and consistent with your commercial aims and considerations
  • Contract drafting – we amend existing contract forms to reflect your requirements or draft bespoke contracts where required, including Framework Agreements
  • Commercial advice – the commercial arrangement is critical to project success (ie: a well implemented Target Cost contract is often the best way of achieving efficiency savings – lump sum contracts will not achieve this) – we ensure that we understand your commercial aims and provide appropriate advice
  • Developing supporting processes – having made all the right contractual choices it’s essential that the administrative processes are clear and easy to use and that the whole team knows what is expected of them – we ensure that the processes work effectively
  • Problem solving - where problems or disputes have already arisen we aim to resolve them swiftly and effectively and, wherever possible, protect business relationships between the parties
